Terms and Conditions

§1. General Provisions

The online store SxToys (hereinafter: "Store") has the following contact details:

The Store operates based on the provisions set forth in these Terms and Conditions.

These Terms and Conditions specify the rules for using the Store, placing orders for products available in the Store, delivering ordered products to the Buyer, paying for the products, the Buyer’s right to withdraw from the contract, rules for submitting and processing complaints, and the protection of personal data.

To use the Store, including browsing the assortment and placing orders, the following are required:

• A device with internet access and a web browser.

• An active email account.

• Enabled cookies support.

• Minimum 18 years of age.

All information about the products in the Store, including descriptions, images, and prices, is an invitation to conclude a contract and does not constitute an offer within the meaning of the Civil Code.

§2. Definitions

• Buyer – An adult natural person, an adult legal entity, or an organizational unit without legal personality, using the Store, especially by making a purchase.

• Consumer – An adult natural person purchasing goods unrelated to their business or professional activity.

• Entrepreneur – A natural person, legal entity, or organizational unit conducting business or professional activity.

• Terms and Conditions – These Terms and Conditions of the Store.

• Store – The online store SxToys available at the URL: www.sxtoys.pl.

• Seller – SxToys.

• Products – Movable items available for sale in the Store.

• Sales Agreement – A distance contract concluded between the Buyer and the Seller concerning the sale of Products through the Store.

§3. Rules for Using the Store

• The Buyer is obliged to use the Store in a lawful and fair manner, respecting the personal and property rights of third parties.

• The Buyer is prohibited from delivering unlawful content.

• The Store can be used without registration, but registration may simplify the ordering process and provide additional features.

• Only individuals who are at least 18 years old may use the Store.

• The Seller is responsible for the compliance of the goods with the contract (warranty – 2 years).

§4. Placing Orders

Orders can be placed through the Store’s website 24 hours a day, 7 days a week.

To place an order, the Buyer should:

• Select the product(s) from the Store’s offer and add them to the shopping cart.

• Go to the shopping cart, select the delivery and payment method.

• Fill in the order form, providing the necessary details.

• Confirm the order by clicking the appropriate button.

• Be at least 18 years old.

After placing the order, the Buyer will receive an order confirmation to the provided email address. The moment the confirmation is received, the sales agreement between the Buyer and the Seller is concluded.

The Seller reserves the right to verify the order and withdraw from the order fulfillment if the Buyer provides incomplete or false data.

§5. Prices and Payments

• All product prices are in Polish Zloty (PLN) and include VAT.

• The price indicated for each product is binding at the time the order is placed by the Buyer.

• The Store offers the following payment methods:

  • Online payment via electronic payment system.

  • Payment via Blik.

The Buyer is obliged to make payment for the ordered products and the selected delivery method no later than 7 days from the date of concluding the sales agreement. If the payment is not made within this period, the Seller has the right to withdraw from the sales agreement.

The payment service provider for online payments through quick transfers is PayPro S.A.

§6. Delivery

• The Store delivers products within Poland.

• Delivery of products is made to the address provided by the Buyer in the order form.

• Available delivery methods and delivery costs are specified in the ordering process.

• The delivery time is up to 7 business days from the payment registration date, unless a different delivery time is specified for a particular product.

• In case of delays in delivery, the Store commits to promptly informing the Buyer about the reason for the delay and the expected delivery time.

For Gift Vouchers, the only available form of delivery is free Electronic Shipping. Once payment is received, the voucher is sent in a PDF file to the email address specified by the customer.

§7. Right to Withdraw from the Agreement

• The Buyer, being a Consumer, has the right to withdraw from the sales agreement without providing a reason within 14 days of receiving the product.

• To exercise this right, the following conditions must be met: the product must be unused, undamaged, and in its original packaging; intimate products like vibrators, dildos, etc., for hygienic and health reasons, may only be returned if the packaging has not been opened. A proof of purchase and a completed return form must be attached.

• The Buyer should use the withdrawal form template available on the Store's website.

• In case of withdrawal from the agreement, the Buyer is obliged to return the product without delay, no later than 14 days from the date of notifying the Seller about the withdrawal.

• The Buyer bears the cost of returning the product.

• The payment refund will be made promptly, no later than 14 days from the date the Seller receives the returned product. The refund will be made using the same payment method used by the Buyer in the original transaction unless the Buyer agrees to another solution. In any case, the Buyer will not incur any charges related to the return.

§8. Complaints

• The Seller commits to delivering products free from physical and legal defects.

• In case of factory/production defects that were not caused by the use of the product or non-compliance with the contract, the Buyer has the right to submit a complaint.

• Complaints can be submitted by filling out the complaint form available on the Store’s website or sending a complaint to the Seller’s email or postal address.

• The complaint should contain at least: the Buyer’s name, email address, order number, a description of the defect or non-compliance, photos, and the Buyer’s request regarding the complaint.

• The Seller will review the complaint within 14 days from the date of receipt and will inform the Buyer of the decision regarding the complaint.

• If the complaint is accepted, the Seller commits to replacing the product with a new one or refunding the purchase cost.

§9. Personal Data Protection

• The administrator of personal data of the Buyers is SxToys.

• Personal data of Buyers is processed for the purposes of order fulfillment, complaint handling, communication with the Buyer, and, with their consent, for marketing purposes.

• The Buyer has the right to access their personal data, correct it, and request its deletion.

• Detailed information on the processing of personal data can be found in the Privacy Policy available on the Store’s website.

§10. Final Provisions

• The Seller reserves the right to change these Terms and Conditions. Changes will take effect on the date of publication on the Store’s website and will apply to agreements concluded after their introduction.

• In matters not regulated by these Terms and Conditions, Polish law applies, in particular the Civil Code and the Consumer Rights Act.

• Any disputes arising from the use of the Store or concluded sales agreements will be resolved by the court having jurisdiction over the Seller’s registered office, unless the law provides otherwise for jurisdiction based on the Consumer’s place of residence.

• These Terms and Conditions take effect on the date of their publication on the Store’s website.
